What is RTI and How to Use It

The Right to Information Act, 2005 gives every Indian citizen the right to request information from any public authority โ€” central government, state government, municipal bodies, courts, and public sector companies. The public authority must respond within 30 days (48 hours for matters involving life or liberty).

What you can ask: Any information held by a public authority โ€” documents, files, records, data, contracts, expenditure, audit reports, meeting minutes, correspondence, and more. You can also request certified copies of documents.

Fee: Central RTI applications require a fee of โ‚น10 payable by IPO, demand draft, bankers cheque, or cash at the counter. BPL (Below Poverty Line) applicants are exempt. Many state governments have different fees.

First appeal: If you are not satisfied with the response or if there is no response within 30 days, you can file a First Appeal with the First Appellate Authority of the same department. Second appeal goes to the Central/State Information Commission.

Is RTI application free? โ€บ
For Central Government, the application fee is โ‚น10 payable by Indian Postal Order, demand draft, or cash. BPL (Below Poverty Line) card holders are completely exempt. State governments have varying fees โ€” some states like Maharashtra, Rajasthan charge โ‚น10, others may charge differently.
What happens if I don't get a response in 30 days? โ€บ
If the PIO fails to respond within 30 days, you can file a First Appeal with the First Appellate Authority of the same department within 30 days of the deadline. If that fails too, you can file a Second Appeal or complaint with the Central Information Commission (CIC) or State Information Commission (SIC). The PIO can be penalised โ‚น250 per day up to โ‚น25,000 for delay.
Can I file RTI online? โ€บ
Yes. For Central Government ministries and departments, you can file RTI online at rtionline.gov.in. Online fee payment is also available. Several state governments also have online RTI portals. For others, you need to send the application by post or submit in person.
What information can I NOT ask through RTI? โ€บ
Section 8 of the RTI Act exempts: information affecting national security, cabinet papers, information received in confidence from foreign governments, personal information that has no public interest, trade secrets, information related to ongoing investigations, and information that would endanger someone's life. Private companies are not covered by RTI unless they are substantially funded by government.
