What to do, in order
- Ask in writing first. Send the demand letter to the employer by email, WhatsApp and registered post, and keep the proof. Many employers pay at this step.
- Know the deadline. Under the Code on Wages, 2019 (in force from 21 November 2025), monthly salary is due before the 7th of the next month, and within 2 working days if you resign or are removed (section 17). Only deductions allowed by the Code can be made, and together they cannot be more than 50% of the wages (section 18).
- Not paid? File a claim with the Labour Department of your state — the office of the Labour Officer / Assistant Labour Commissioner for the district where you worked. Under section 45 the authority tries to decide within 3 months and can order compensation of up to 10 times the claim. You must file within 3 years. You can also file online on the Ministry of Labour’s SAMADHAN portal (wage claims, delayed payment, unauthorised deduction).
- Keep proof: appointment letter or ID card, salary slips or bank credits, attendance, chats or emails asking for the salary.
- Not for: government jobs (Chapter III of the Code does not apply to government establishments unless notified — use your department’s grievance channel or CPGRAMS). PF is separate — use the EPFO grievance tool. Sources checked 1 Nov 2026. This is a draft to help you, not legal advice; for large amounts or a court case, see a lawyer or your district legal services authority.

Questions people ask
My company has not paid my salary — what is the first step?
Ask in writing: send a demand letter (this page writes it) by email and registered post, giving 7–15 days. Keep the proof. If it is still not paid, file a claim with the Labour Department.
By when must salary be paid?
For monthly salary, before the 7th day of the next month; within 2 working days if you resign or are removed — section 17 of the Code on Wages, 2019.
Where do I complain if the salary is still not paid?
To the Labour Department of your state (Labour Officer / Assistant Labour Commissioner for the district where you worked), or online on SAMADHAN (samadhan.labour.gov.in). The claim is under section 45 of the Code on Wages, 2019.
Is there a time limit to complain?
Yes: 3 years from the date the wages fell due (section 45(6)). A later claim can be taken if you show sufficient cause for the delay.
Can the employer cut my salary?
Only for the deductions the Code allows (for example absence, advances, loans, tax, PF), and all deductions together cannot be more than 50% of the wages (section 18).
Can I write it in Hindi?
Yes. Choose हिन्दी above the form, and पुरुष or महिला so the verbs are right.
