What goes in a trust deed

The settlor, the trust's name and office, the initial fund, the objects, the trustees and how they are appointed and removed, meetings, the bank account, accounts, powers and what happens if the trust ends. Every term is editable — add your own in "Other terms".

Registration and tax: a trust that holds land or a house usually has to be registered at the sub-registrar's office, and some States have their own law and office for public trusts. Registration with the Income Tax Department (for example to give donors a tax receipt) is a separate step. Ask the sub-registrar, a lawyer or a CA before you sign.

Stamp paper and signing

Whether this needs stamp paper, and of what value, depends on your State and on the document — ask the stamp vendor, a notary or a lawyer. Tick "Printing on stamp paper?" to leave the space at the top of page 1. This is a draft in plain words: for a large amount or anything you may have to rely on in court, have a lawyer read it first.

Questions people ask

What is a trust deed?
The document that creates a trust: the settlor sets apart money or property for stated objects, and names trustees who hold and manage it for those objects.
Public or private trust — what is the difference?
A public charitable or religious trust works for the public or a section of it (education, health, a temple); a private trust works for named people, such as family members.
How many trustees can there be?
You choose — type the least and the most. Add each first trustee as a row; the deed lists them in a schedule with a signature column.
Does a trust deed need registration or stamp paper?
Often yes — it depends on the State and on whether the trust holds land or a house. Ask the sub-registrar's office or a lawyer.
Is my data uploaded?
No. The deed is made in your browser and the PDF is created on your device.
